By booking my services, you agree to the terms of this agreement with HAKIMA TANTRIKA ("HAKIMA TANTRIKA" or "Coach"). Your (“Client,” "You"or "Your”) continued acceptance of and compliance with the terms of this agreement are a condition precedent to your right to use HAKIMA TANTRIKA's services. If you do not accept the terms of this agreement, please do not book a service. By accessing, viewing or using this side, you signify that you are eighteen years age or older, and are authorized to enter into this contract.

1. Description of Coaching and Tantra Initiations

Coaching and Tantra Initiations are a partnership (defined as an alliance, not a legal business partnership) between Coach and Client in a thought-provoking and creative process that inspires Client to maximize personal potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.

2. Coach-Client Relationship

2.1 Coach agrees to maintain the ethics and standards of behavior outlined in the Code of Ethics.

2.2 Client is solely responsible for creating and implementing their own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and their coaching calls and interactions with the Coach.

As such, Client agrees that Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by Coach. 

Client understands coaching or tantra sessions are not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

2.3 Client further acknowledges that they may terminate or discontinue the coaching relationship at any time.

2.4 Client acknowledges that coaching and tantra sessions are a comprehensive process that may involve different areas of their life, including work, finances, health, relationships, education and recreation. Client agrees that deciding how to handle these issues, incorporating coaching or tantra principles into those areas and implementing choices is exclusively Client’s responsibility.

2.5 Client acknowledges that: 

• Coaching and tantra sessions do not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association.

• Coaching and tantra sessions are not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals. 

• It is Client’s exclusive responsibility to seek such independent professional guidance as needed. 

• If Client is currently under the care of a mental health professional, it is recommended that Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by Client and Coach.

2.6 Client understands that in order to enhance the coaching relationship, they agree to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.

3. Duration & Terms

3.1 Client is going to undertake a number of sessions previously agreed between HAKIMA TANTRIKA and Client. Each session is limited to 60 minutes or 90 minutes for coaching and 120 minutes for tantra sessions. 

3.2 Each session takes place online through Zoom or in-person.

3.3 Client is welcome to communicate with HAKIMA TANTRIKA between scheduled calls via email (clients@hakimatantrika.com). Coach will respond to all inquiries within 48 hours (unless indicated otherwise in advance). Feel free to reach out if you hit a “sticky” spot or would like to share any success along the way. 

3.4 If Client needs an “emergency call,” HAKIMA TANTRIKA can usually accommodate within the same week. Client will not be billed for any call less than 20 minutes in duration. 

3.5 After the successful completion of the program, Client agrees to provide a video testimonial for HAKIMA TANTRIKA. This testimonial will be published on HAKIMA TANTRIKA’s website and will serve as a testament to Client's achievement in “moving beyond limitations.” The provision of this testimonial is deemed compulsory and serves as tangible evidence of reaching a significant milestone. Client's name can be changed at their discretion.

4. Payment

4.1 Prices listed on HAKIMA TANTRIKA’s website are in US Dollars, “starting at” price per person unless otherwise stated and are inclusive of VAT.

4.2 After booking a discovery call, HAKIMA TANTRIKA will inform CLIENT with the exact prices.

4.3 Client should pay the price eight 48 hours before the commencement of the coaching relationship. Client will be required to pay fee in full in order to start working with HAKIMA TANTRIKA. Monthly payment plans are also available. Paid monthly amount is non-refundable, if the booking is canceled.

4.4 Client will receive an invoice with options to pay by credit/debit card via STRIPE.

5. Rescheduling & Cancellations

5.1 Client will show up at the mutually scheduled time for the coaching session or tantra initiation. 

5.2 If Client has to reschedule, Client will do so with a minimum 48 hours’ notice by email. Failure to do so will result in a forfeiture of the session, unless otherwise agreed upon between Client and Coach by email.

5.3 Should Client “no-show” for two appointments (without notification or rescheduling), Coach reserves the right to terminate the relationship. Fees are nonrefundable for the unused portion of the remaining sessions. 

5.4 Client agrees to schedule at least two sessions per month unless mutually agreed between Coach and Client.

5.5 If Client has purchased a package and is unable to use the sessions for any reason, you may put the remaining sessions on a three-month hold. Session credits will not be carried out further than three months. Fees are non-refundable should you decide to “quit” the process.

4. Confidentiality 

4.1 This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound by the principles of confidentiality. However, please be aware that the Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. 

4.2 Coach agrees not to disclose any information pertaining to Client without Client’s written, NOTARIZED consent. 

4.3 Confidential Information does not include information that:

• was in the Coach’s possession prior to its being furnished by Client; 

• is generally known to the public or in Client’s industry; 

• is obtained by Coach from a third party, without breach of any obligation to Client; 

• is independently developed by Coach without use of or reference to Client’s confidential information; 

• is required by statute, lawfully issued subpoena, or by court order to disclose;

• is disclosed to Coach and as a result of such disclosure, Coach reasonably believes there to be an imminent or likely risk of danger or harm to Client or others; 

• involves illegal activity. 

4.4 Client also acknowledges their continuing obligation to raise any confidentiality questions or concerns with Coach in a timely manner.

4.4 Both Client and Coach agree to not take any actions, make any statements, whether oral or in writing, that negatively impact the other party’s business, services, products, or reputation.

5. Waiver of Liability

5.1 Client agrees to notify Coach promptly of any claim or grievance about the services provided herein. 

5.2 Client sole remedy will be the return of unused fees. Coach is not responsible for any direct, indirect, incidental, or consequential damages beyond the total amount of fees paid. 

5.3 Client hereby releases, waives, acquits and forever discharges Coach from every claim, suit, action, demand or right to compensation for damages Client may claim to have or that Client may have arising out of actions, omissions, or commissions taken by Client or by Coach, as a result of the advice given by Coach or otherwise resulting from the coaching relationship contemplated hereunder. Client further declares and represents that no promise, inducement or agreement not herein expressed has been made to Client to enter into this release. The release made pursuant to this paragraph shall bind your heirs, executors, personal representatives, successors, assigns and agents. 

This Terms of service shall be binding upon the parties hereto and their respective successors and permissible assigns.
